Studio Bookings

You are reponsible of ensuring that all persons taking part in the photo session are aware of the following Terms & Conditions.

1. COPYRIGHT: S&B Photography own Copyright © to all photographs taken under the United Kingdom Copyright Act 1988, be it at the studio or any location. All rights reserved.
2. PAYMENT: Cash, cheque, credit / debit card. Credit cards +2.5% charge.
3. BOOKINGS: Mon-Sat between 10am & 6pm (subject to availability). Bookings from 4.45pm +£10.00 3.1 All bookings must be confirmed by S&B Photography, either by phone or email. Call logs are taken and emails are monitored. If you have not received a booking confirmation email from us regarding an online enquiry, your booking will NOT take place. Confirmation of the exact date and time will be emailed to you and a reply must be sent to us for the booking to be made. 3.2 Service charge payable on arrival or upon booking for on location work or in any circumstance within 14 days of invoice by prior arrangement with a 50% deposit paid upon booking.3.3 Max. attendance per studio booking: 1-10 adults, 1-15 children, 1-5 pets or mix 3.4 Client is to give sufficient notice of cancelation to S&B Photography, 24 hours where possible 3.5 Persons under 18 years must be accompanied by parent, legal guardian or nominated responsible adult on arrival. If parent / guardian is unable to attend, a parental consent form must be requested and the completed form must be submitted on arrival and minor(s) must be accompanied by the nominated responsible adult stated on parental consent form 3.6 All persons under the age of 16 years must be accompanied by parent / legal guardian or nominated
responsible adult over the age of 18 years, stated on parental consent form for the duration of the photo shoot 3.7 Identification may be required; UK Driving License or Passport only. ID will be copied and kept on record 3.8 On occasions, it may be necessary for S&B Photography to cancel or re-schedule bookings at short notice due to unforeseen circumstances. We reserve the right to cancel and re-schedule bookings at anytime by informing the client in writing or by phone at short notice.
4. VOUCHERS: Gift vouchers, promotional vouchers and codes must be surrendered on arrival to apply.
5. PHOTOGRAPHIC AGREEMENT & RELEASE: To be completed by model / client over the age of 18 years or parent / legal guardian or responsible nominated adult stated on submitted parental consent form only.
6. CONDUCT: S&B Photography have zero tolerance toward alcohol, smoking and anti social behaviour on the premises. Offensive, rude or dangerous behaviour will not be tolerated. We reserve the right to bar you from the premises without refund of monies or any other liability if in our reasonable opinion, your behaviour is deemed to be unacceptable.
7. POLICIES: Any order(s) placed will be subject to the full Terms & Conditions set out in S&B Photography’s order policy.
8. ADVERTISEMENT EXEMPTION: Available for a small administration fee of £1.00 per exempt image or maximum charge of £50 for all images (per booking) commencing on receipt of full payment. Selected services will be unavailable. NB Advertisement exemption does not guarantee total exemption from public view. The work may appear in the photographer’s portfolio.
9. PHOTOGRAPHY COVERAGE: Any suggested pose is optional and undertaken at the clients own risk 9.1 Photo session shall not exceed 60 minutes per booking, no minimum duration. Studio viewing slot shall not exceed 60 minutes per viewing, no minimum duration 9.2 Photographic coverage will be as the photographer's professional expertise determines and that no one photograph will be deemed more important than another 9.3 Special requests are not a binding instruction, although every effort is made to comply with the clients wishes. Special requests must be made by the client to S&B Photography in writing.
10. TRAVEL EXPENSES: Travelling expenses apply for on location bookings exceeding 10 miles from SY8 1DJ.
11. LIMITATION OF LIABILITY: S&B Photography will not be held responsible for failure of services beyond our control. We do not accept any liability for any damage, loss or injury to you or any of your party or vehicles or possessions, unless proven to have been caused by a negligent act by ourselves, employees or agents acting in the course of employment.
11. BREACH OF TERMS & CONDITIONS: S&B Photography reserves the right to revoke, repossess and terminate any licence, service, media or product for non-compliance of our terms & conditions without notice. No refund will be issued. No liability is accepted. Should the breach involve copyright infringement, the case may be referred to appropriate authorities for which you will be liable to pay all costs relating to any claim.

Order Policy

1. PAYMENT: 50% non-refundable deposit is required for professionally framed products, canvas and all orders over £100. Any remaining balance is due upon collection or in any circumstance, within 14 days from date of order. Acceptable payment methods: Cash, cheque, credit / debit. Credit cards +2.5% charge.
2. REFUNDS: Due to the personal nature of each item, no returns are accepted. All sales are final.
3. ORDER CONFIRMATION: Once order is confirmed by the client, a contract has been agreed. Amendments are not accepted and the full amount is payable.
4. PRODUCTS: Offered subject to availability 4.1 Products (excluding discs and prints up to 10x12”) are available for studio collection only or local delivery within a 25 radius of Ludlow subject to
delivery charge by prior arrangement. 4.2 P&P is to be paid by the client to S&B Photography in full upon arrangement 4.3 Discs and prints order up to size 10x12” are available for delivery subject to additional charge.
5. CANCELATION: The client may cancel order at anytime by informing S&B Photography in writing but in doing so, shall forfeit deposit paid.
6. COMPLETION: The client shall place the order in the full knowledge that any advised completion date(s) are approximate and cannot be guaranteed 6.2 Time scale for completion: 2-28 working days from date of order 6.3 S&B Photography accept no liability for delayed completion for any reason 6.4 If S&B Photography are unable to complete the order within 28 days, a full refund,
including any deposit paid, for any item(s) not completed will be issued to the client.
7. LIMITATION OF LIABILITY: In the unlikely event of failure to complete the order within 28 working days from date of order, liability shall be limited to a full or partial refund of any monies paid.
9. COLLECTION: The client must contact S&B Photography to arrange a collection slot to guarantee availability. 9.1 The named client must collect the order and complete a product release (reverse). 9.2 Any suspected error(s) must be reported upon collection. Reports made after this time are not accepted.
10. DAMAGES: S&B Photography will not be held liable for any damage that may occur to any part of the once the item(s) have left the premises.
11. RELEASE: No items will be released until full payment has cleared and the product release has been completed (reverse).
12. RESERVED RIGHTS: S&B Photography reserve the right to update these Terms & Conditions without notice.

Online Viewing Gallery (OVG)

1. Service charge applies for a minimum 12 Months online viewing from date of activation.
2. The gallery will be activated within 2-10 working days from cleared payment.
3. Service charge is non- refundable.
4. This service is offered strictly for viewing purposes only.
5. Log in details are case sensitive. Names will start with a block capital & passwords will be lower case. If you experience any problems viewing the images, please contact us via the website contact page or call the studio directly on (01584) 872340.
6. S&B Photography take reasonable steps to ensure that www.s-b-photography.co.uk is available 24 hrs every day, 365 days per year. However, websites do sometimes encounter downtime due to server & other technical issues, therefore, we will not be liable if this website is unavailable at any time.

8. If you wish to renew your online viewing gallery, please contact us. The renewal charge is half price for an additional 12 Months. This charge also applies if you require a new password for any reason.
9. We aim to activate your online gallery before / by the date on the front of the web card, however, this can't always be guaranteed. If you are still unable to log in after the activation date, please contact us.
10. S&B Photography reserve the right to terminate the online viewing without notice if it is found that these terms have been broken. No refund will be provided.

Wedding Bookings

1. Agreement: It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. The Photographer(s) S&B Photography: The client understands that S&B Photography will be the sole official professional photographer's on the day. No other paid photographers will be covering this Wedding. It is the client's responsibility to ensure that any family members or guests taking photographs at the Wedding do not obstruct S&B Photography from carrying out the contracted work. On occasions and without notice, it may be necessary for the photographer originally specified to be substituted by another photographer ( e.g. due to ill health).
3. Special Requirements / Instructions / Coverage: The client understands and accepts that the photographic coverage will be as the photographer's professional expertise determines and that no one photograph will be deemed more important than another. Special requirements are not a binding instruction, although every effort is made to comply with the clients wishes. Any special requests not notified on this booking form must be made by the clients to the photographer in writing.
4. Licence: The photographer(s) shall be granted artistic licence in relation to the poses photographed and the locations used. The photographer(s) judgement regarding the locations, poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture all images requested by the client.
5. Travelling expenses: Venue's within a 25 mile radius of Ludlow SY8 1DJ will not be subject to travelling expenses. Venue's Further than 25 miles from SY8 1DJ may be subject to charge. The fee will be agreed between both parties and stated on the booking form. No additional travelling expenses will be incurred unless previously stated.
6. Restrictions: S&B Photography will not be held responsible for any venues (Church, Hotel etc) that have restrictions in place that prevent images from being taken. The client is responsible for enquiring to whether any such restrictions may be in place.
7.Photo editing: The photographer will perform a standard amount of retouching to bring the photographs to a quality of which he is proud. Further retouching, digital manipulation and artist finishing is available to the client as an optional extra.
8. Copyright / Model release form:A model release form is not required for Wedding services. It is the client's responsibility to make all guests aware of S&B Photography's presence & details of the work that S&B Photography have been contracted to carry out. S&B Photography remain the official copyright holders of all images. S&B Photography assign several non commercial exclusive rights to the named clients that apply to all high resolution photographs provided on disc:
• To produce copies or reproductions
• To transmit or display electronically
• To perform or display the work publicly
9. Files: Negatives / digital files remain the property of S&B Photography.
10. Force Majeure: The due performance of this contract is subject to alteration or cancellation by either party owning to any cause beyond their control.
11. Preview: Clients are required to attend a studio preview after the Wedding on the date and time arranged to view the photograph's and
choose any items included in the contract (prints etc). There is a max allocated time of one hour per preview.
12. Images: All image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by the combination of certain dyes and materials especially manmade fibres.
13. Prints / Products: All clients are required to sign an order form to confirm that the image numbers are correct. Upon collection, a product release form must also be signed before any item(s) leave the premises. This release form is put in place to confirm that the client(s) are satisfied with all aspects of the order e.g. print colour / quality etc. Any required alterations (image colour / saturation etc) must be brought to S&B Photography's attention before this form is signed. Once the product release form has been signed, S&B Photography are unable to accept returns of this nature.
14. Refunds / Returns: Due to the personal nature of each item, S&B Photography to do accept returns / offer refunds.
15. Display: With reference to the Copyright agreement, the client hereby allows S&B Photography to display any images included in this contract in their studio(s), portfolio(s), literature, Wedding, exhibitions and advertising. If clients wish to be exempt from public display, this must be stated in writing on booking form under special instructions. A £10 admin fee will apply and is payable on / before release of products / media.
16. Completion: An approximate completion date for named items within the contract will be provided on request. Due to the many factors that may affect the time scale for completion (suppliers etc), S&B Photography will be unable to guarantee the date provided but will keep clients well informed of any delays etc by the client's favoured means of contact.
17. Cancellation: The client may cancel this contract at any time by giving written notice to S&B Photography, but in doing so, shall forfeit any monies paid. If a cancellation notice is received less than 30 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 50% of the contract value. Should notice of cancellation be received less than 14 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 100% of the contract value. This said sum shall be payable as compensation as an estimate of the loss S&B Photography would suffer.
18. Limitation of Liability: In the unlikely event of a total photographic failure or cancelation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect consequential loss.
19. Deterioration: S&B Photography will not be held responsible for any deterioration of prints / products due to improper care & handling. It is the client's responsibility to ensure that prints are stored flat, away from heat and direct sun light.
20. Complaints: Any complaints should be raised by the client with S&B Photography, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of images.
21. Client(s): The Client's are the two people stated who have signed this booking form. S&B Photography will only deal directly with the named clients on this contract (whether they be the bill payers or not). If required, the clients can nominate one relative to take full responsibility for dealing with S&B Photography.
22. Reserved Rights: S&B Photography reserve the right to update these Terms & Conditions without notice.

Commercial Bookings

1. Payment: Full service charge to be paid upon booking. Total service charge must be paid in full before any products / media / Lisence is released. Payment Methods: Credit cards ( + 2.5% charge) Debit card ( no surcharge) Cheque Payment made payable to S&B Photography, BACS.

13. Cancellation: The client may cancel this contract at any time by giving written notice to S&B Photography. Failure to give written notice to S&B Photography will result in a charge of 45% of the total service price.
14. Client(s): The Client is the person stated on the quotation / booking form. S&B Photography will only deal directly with the named client(s), whether they be the bill payers or not.
15. Limitation of Liability: In the unlikely event of a total photographic failure or cancelation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect consequential loss
16. Courier / Postal Service: Any item that requires posting will be sent via tracked courier / recorded delivery. Delivery charges are to be paid in full by the client. S&B Photography will not be held responsible for any delays that may be ex by postal service provided.
17. Copyright S&B Photography remain the sole, official Copyright holders of all images lisenced. S&B Photography assign (lisence) several non-commercial exclusive rights to the named clients (Business Use License) that applies to high resolution digital files provided on disc (license applicable upon full, cleared payment only).

Business Use License:
• To produce copies or reproductions (for personal, promotional / advertisement purposes)
• To transmit or display electronically (For advertisement purposes)
• To perform or display the work publicly (For advertisement purposes)

17. Reserved Rights: S&B Photography reserve the right to update these Terms & Conditions without notice.

  • Promotion details: 
    • 1x Free studio photo session. 1x Free 10x8” Fine Art Print , all professional editing and up to a 1 hour studio viewing slot (subject to availability) valid from 11/11/11 until 11/12/11. Free facebook photo upload on request (T&C's apply).
    • A minimum of 2 studio visits required (studio photo session + studio viewing slot) by appointment.
    • Not exchangeable for cash or any other service / product
    • Any other product / service is subject to additional charge (including P&P if required).
  • Bookings: Usual Studio booking Terms & Conditions apply (top of page).
    • Promotional bookings are accepted via www.facebook.com/sandbphtography only
    • Offered Mon-Sat between 10am & 4pm on a first come, first served basis, subject to availability.
    • Dates(s) / time(s) offered can only be guaranteed available at the time of reply and for 24 hours from when we issue notice of a provisional booking.
    • Bookings are unconfirmed until accepted by S&B Photography
    • No guarantee can be given for availability of a future booking in the event of cancelation.
  • Attendance: The person making the booking must attend the photo session.
    • Maximum of 10 adults / 15 children / 5 pets / mix.
    • Duration of studio shoot will be as the photographer determines, between 10-45 minutes based on the number of people in attendance / ages and type of photo shoot.
    • Studio sessions that apply: Individuals, family, friends, couples, baby, pets.
    • Persons under the age of 18 years must be accompanied by a parent / legal guardian.
    • At least 1 responsible adult must be present and completed parental consent form(s) must be submitted on arrival for any person taking part who is under the age of 18 years, whose parent / legal guardian will not be present
  • Usage: Maximum of 1 free shoot + free print 10x8” per person, per promotion term 11/11/11 until 11/12/11.
