Service Policy 'Terms of Service'

Definitions

'Us', 'Our' 'We', 'the Photographer' refers to S&B Photography. 'Client', 'you', 'yourself' refers to the individual &/or business submitting the booking request.

Booking Requests

Appointments are accepted subject to availability via our online booking form, in accordance with our full Terms of Service "Service Policy". All bookings are considered provisional until accepted & confirmed by us in writing. Standard Booking Procedure: 

1. Click 'Book Now' link, select Service & 'Request Booking' > Complete all required (*) fields & submit > On screen prompt will advise your request has been sent. We aim to reply within 24 hours.

2. If available, we'll issue an e-mail invoice for immediate payment via our secure checkout & provisionally hold availability for up to 48 hours. 

3. Once full payment is complete, we'll issue booking confirmation via e-mail, usually within 24 hours. If not received, please contact us.

Payment Terms

Booking fee (inclusive of any selected Add-on service) is payable upon order via debit/credit card through our secure, online checkout; Methods: PayPal / Apple Pay / Google Pay. BACs payment also accepted on request directly to Joseph Summerfield-Brookes (Partner / Photographer).

Appointments

• Accepted subject to availability, Monday-Saturday, 10:00am - 2:00pm (Property Photography). Sunday, evening & Bank Holiday bookings also accepted, subject to additional charge.
• Booking calendar is for selection purposes only & may not reflect accurate availability. Whilst every effort will be made to offer an appointment on a preferred date (when provided upon booking), availability cannot be guaranteed.

S&B Photography own Copyright © to all photographs taken. All rights reserved. For Download Packages, a selection of high-resolution, unwatermarked images will be supplied as online download (jpeg) via client account, licensed to the client for Promotional Use (Marketing purposes) for Commercial / Property Photography & Personal Use for all other bookings. 

Coverage

• Photographic coverage will be as the Photographer determines & no one photograph will be deemed more important than the other. We shall be granted artistic license in relation to the poses photographed & locations used; the Photographer’s judgement regarding locations, poses & number of images taken shall be deemed correct.
• We accept no liability for lack of photographic coverage due to & not limited to anyone in attendance that may be late, interfere with or restrict the photographer’s duty, restrictions imposed by venue(s) or other official entities, vagaries of the weather or willingness of subjects.
• Special requests are not a binding instruction, however, every effort will be made to facilitate any written requests.
• We aim to supply minimum 15 images, however, this is dependant on property & conditions at the time of appointment. Max. 60 images per property.
• The photographer is not responsible for preparation, staging or moving furniture or any personal belongings; properties are photographed as presented on the day of confirmed appointment.
• Advance photo editing is available to order via client gallery, subject to additional charge on a per image basis.
• A Photographic Agreement ('Model Release') is to be completed on arrival by all persons over 18 years participating in a photo shoot (to be completed by parent/legal guardian for children under 18 years).

Photo Editing

Image processing & standard photo editing / finishing will be undertaken to bring the photographs to a quality of which the photographer is satisfied (colour balance, contrast & crop). Further advanced re-touching & digital manipulation is available, subject to additional charge. Image sizes are nominal. We will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by the combination of certain dyes and materials; especially man-made fibres.

Turnaround

Download gallery is typically activated by 1:00pm next working day but not guaranteed; please allow 48 hours from site visit.

Cancellation & Refund Policy

• Prior to confirmed site visit, an appointment may be cancelled by the client in writing in return for a full refund to original payment method or account credit, issued within 28 working days.
• Cancellation Fees: A fee equal to 20% of order value applies & will be retained for same day cancellation or no access on arrival. Site visit completed orders are non-refundable in any event.
• If we're unable to fulfil a booking request for any reason, our liability is limited to a full refund of the order value to original payment method within 28 working days.
• We reserve the right to cancel & reschedule appointments at any time, without notice. Whilst every effort will be made to provide adequate notice, due to reasons beyond our reasonable control, this is not always possible.

360° Matterport Tour (Add-On Service)

• This service is provided subject to third party hosting terms and conditions. 
• Link to property tour is valid for 6 months from date of activation.
• Paid extension may be possible via active client gallery, subject to availability.
• 360° exterior shots rely on suitable weather conditions on the day of appointment; it is not possible in high wind or wet conditions & they cannot be added to the tour at a later date, therefore, the client or vendor must contact us to reschedule if inclusion of exterior shots is important.

Floor Plan (Add-on Service)

Measured at time of Photography site visit & provided as PDF download; the floor plan is for illustrative & marketing purposes only & intended to give a general indication of the property's layout. It is not drawn to scale unless explicitly stared otherwise & all measurements are approximate. No liability is accepted for any inaccuracies, omissions or subsequent changes to the property. The floor plan does not form part of any contract or offer.

Policies

All orders are subject to the terms set out in our Website Disclaimer, Privacy Policy, Order Policy & Web Gallery Terms of Use. Separate Terms & Conditions apply for Wedding Bookings.

Limitation of Liability

We will not be held liable for any obstruction or restriction that limits or prevents us from carrying out photographic coverage. In the unlikely event of total photographic failure or cancellation of this contract by either party under any circumstance, the liability of one party to the other shall be limited to the total value of this contract. Neither party shall be liable for indirect or consequential loss, in any event.

Complaint Procedure

Any complaint must be raised by the client to S&B Photography in writing within 28 days from confirmed appointment & in any event, within 7 days of receipt of goods.
